iFLY Gift Card Full Gift Card Terms and Conditions

Terms: These terms and conditions (the “Terms”) govern the iFLY Gift Cards (each a “Gift Card”) and constitute a legally binding agreement between the Card Issuer and you. Your purchase, use or acceptance of a Gift Card constitutes your agreement to the Terms. Please read these Terms carefully. The Terms include a change in terms provision, a binding arbitration clause, and a waiver of class action provision. If you do not agree with any of the Terms, do not purchase or accept a Gift Card.
The Gift Card Issuer and Sole Obligor -- Novation
The Gift Cards are issued by SkyGroup Investments, LLC or its Affiliates, as defined herein (collectively, the “Card Issuer”). Cards sold by Colorado Springs, Colorado, Jacksonville, Florida, Miami, Florida, and Wilmington, North Carolina iFly locations are issued by HiFLYGHT LLC, Sky Entertainment Jacksonville LLC, Trilogy Tunnel Flight LLC, and FLY Wilmington LLC, respectively (collectively, the “Affiliates”). SkyGroup Investments, LLC or one of its Affiliates is the sole card issuer and the sole obligor to the card owners. The Gift Cards are sold or distributed by authorized sellers on behalf of the Card Issuer. However, these authorized sellers are neither the Card Issuer nor an obligor to you or to any card owner, unless they are named specifically on the Gift Card itself. Card Issuer may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not Card Issuer, will be the sole and only obligor to the card owner. You agree to the foregoing and acknowledge that it results in, or shall be deemed to result in, a novation under which the assignee, and not SkyGroup Investments, LLC or its Affiliates, is the sole and only obligor to you. In furtherance of the foregoing agreements, you hereby knowingly release the assignor from any and all claims that they are obligated to you for the Gift Card.
Purchasing Gift Cards
Gift Cards may be purchased only in the United States and only online at https://www.iflyworld.com/ and authorized selling outlets. Gift Cards purchased in the United States will be denominated in United States Dollars. A Gift Card will not be valid unless and until it is properly acquired and activated. A Gift Card will not be valid if obtained by you from unauthorized sellers or resellers including from Internet auction sites. Once purchased, the Gift Card will not be reloadable. A Gift Card may be purchased and loaded in the minimum amount of $25 up to maximum amount of $500. No single individual may purchase Gift Cards with a total value of $10,000 in any given day. A Gift Card will not be valid unless and until it is properly acquired and activated. A Gift Card also will not be valid if obtained by you from unauthorized sellers or resellers including from Internet auction sites.
Gift Card Purchase Warnings
Gift cards are popular products, but they are targets for fraud perpetrated by scammers designed to entice targets to buy a gift card. For more about fraud visit stopgiftcardscams.com. Do not purchase a Gift Card unless you are purchasing it as a gift or for your personal use. Be vigilant. Furthermore, if anyone insists you buy a Gift Card for use to make a payment, then do not purchase the Gift Card. To the extent permitted by law, Card Issuer is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any Gift Card.
Gift card tampering is a serious fraud scheme. Fraudsters remove a card from a sales rack, tamper with the packaging, steal the card numbers, expose and steal the PIN, replace the packaging and covers, and return the card to the rack. They wait until a purchaser buys the card. When it is activated, they use the stolen card numbers to drain the card and its value resulting in the purchaser holding a valueless card. Be vigilant. When buying a card, examine packaging. Do not purchase if any part of the card, its packaging or security features appear to be removed, ripped, damaged or otherwise tampered with.
About the Gift Card
The Gift Cards are closed-loop instruments which means they are only redeemable or usable for purchases made online at https://www.iflyworld.com/. The Gift Cards are limited-value and limited-use cards. They are not debit or credit cards, an asset account, deposit accounts, or linked to a deposit account. Your Gift Card is not a bank issued card and is not subject to overdraft protection. The balance on the Gift Card is not insured by the Federal Deposit Insurance Corporation or any government deposit insurer or agency. It does not bear interest due to you, and it does not constitute evidence of indebtedness or liability by us to you, except to honor transactions made using the Gift Card in accordance with these Terms.
Gift Card Redemptions and Use
The Gift Cards are redeemable at U.S (excluding territories) authorized and participating iFLY locations only to purchase goods and services online at https://www.iflyworld.com/ or at authorized iFLY locations. Your Gift Card is redeemable only up to the available balance of the Gift Card. If you want to use your Gift Card to make purchases of flight packages or select products in excess of the balance, you must combine use of the Gift Card with another acceptable form of payment. The Gift Card cannot be redeemed for cash or currency, except as required by law.
Limitations on Use
The Gift Cards are subject to limitations on use. Your Gift Card is not redeemable or usable (a) to purchase another Gift Card, (b) to make payment towards previously purchased merchandise or flight packages, (c) at merchants other than https://www.iflyworld.com/ or authorized iFLY locations. The Gift Cards cannot be used in or in furtherance of an illegal transaction. The Gift Cards cannot be redeemed for cash or currency except as required by law. If cash redemption is required by law, then the cardholder agrees that the payment may be made by cash, check, or an electronic funds transfer as such method is selected by the Card Issuer.
Resale is Prohibited
You may not sell a Gift Card or otherwise barter or exchange the Gift Card for value. However, consistent with its intended purpose, you may give a Gift Card to another person for no monetary consideration as a gift.
No Refunds
You may not return or cancel your Gift Card after it is purchased. The Gift Cards are not refundable for cash or currency unless required by law.
Risk of Loss, Damage, Theft or Unauthorized Use
Title to the Gift Card and risk of loss passes to the Gift Card purchaser when a Gift Card is delivered. With respect to physical Gift Cards or digital Gift Cards purchased at a physical location (as opposed to online) that occurs upon delivery of the physical Gift Card or digital Gift Card to the purchaser. With respect to an online purchase of a physical Gift Card, that occurs upon delivery of the physical Gift Card to the designated carrier. With respect to an online purchase of and the electronic delivery of a digital Gift Card, that occurs when the digital Gift Card is clicked by the sender as sent. Card Issuer shall not be responsible for Gift Cards that are lost, damaged, stolen, or used without authorization. Although they are not cash, you should protect your Gift Card like you do cash. You are responsible for the transactions using your Gift Card, whether authorized or unauthorized. Gift Cards will not be replaced or replenished if lost, damaged, stolen, or used without authorization.

No Expiration Date
Your Gift Card balance does not expire. However, a Gift Card may (or may not) be subject to escheat to an appropriate state or territory if and as required by applicable unclaimed property laws. For information about escheat, visit unclaimedproperty.org. You may inquire about the status of the Gift Card funds at https://www.iflyworld.com/redeem-a-voucher/#/gifts. Your Gift Card may not be usable to purchase goods or services in the event the redeeming merchant ceases business or the program is terminated for business reasons. In that event, go to https://www.iflyworld.com/gcterms/ for instructions regarding the use of your card.
No Fees Against the Card Balance
No fees will be charged against the balance of your Gift Card.
Fraud & Unauthorized Transactions
You are responsible for all transactions associated with your Gift Card, whether authorized or unauthorized. Consequently, you should safeguard your Gift Card and not disclose your Gift Card information. Card Issuer reserves the right to assert all available remedies or countermeasures in the event of suspected abuse or fraud. Such remedies and measures shall include, without limitation, the blocking of a Gift Card from use or the refusal by the Card Issuer to issue or honor a Gift Card. Such remedies and measures also shall include the right to void a Gift Card without any refund in the event a Gift Card was obtained by theft, fraud, or unauthorized means (including suspected theft, fraud, or unauthorized means). Card Issuer may use Gift Card balances to offset its liability to card companies, networks and issuers of lost or stolen credit and debit cards used to purchase or load Gift Cards.
Purchased Flights Packages or Products
Your use of your Gift Card to purchase flights packages or products online at https://www.iflyworld.com/ or at authorized iFLY locations will be subject to separate terms and conditions that govern shopping and purchases at https://www.iflyworld.com/. Those terms and conditions are separate from these Terms and may be found at https://www.iflyworld.com/. Refunds, returns, or merchandise credits regarding purchased merchandise or flight packages, if any, will be governed by the policies of https://www.iflyworld.com/ as the seller of the merchandise and flight packages.
Mandatory & Binding Arbitration Agreement and Class Action Waiver
The terms of the DISPUTE RESOLUTION; CLASS ACTION WAIVER; JURY TRIAL WAIVER section of the iFly Website Terms of Use, located at https://www.iflyworld.com/terms, are incorporated by reference herein (the “Arbitration Agreement and Class Action Waiver”). All terms of the Arbitration Agreement and Class Action Waiver apply to the iFly Gift Card Program and all Gift Cards and should be construed accordingly. The Arbitration Agreement and Class Action Waiver is a mandatory and binding agreement and part of the Terms governing your Gift Card. By accepting the Terms of the Agreement, you also are accepting and agreeing to the terms of the Arbitration Agreement and Class Action Waiver.
Please read these provisions carefully. They affect legal rights that you otherwise may have and require binding arbitration of claims instead of resolution in a court of law. They also require Card Issuer and you to submit claims to binding and final arbitration on an individual basis. This means that you will not be able to bring a case or lawsuit in a court of law before a judge or jury. Instead, you agree to submit such claims solely on your own individual behalf to a neutral arbitrator. In addition, you will not be able to bring a class action, collective case, or representative lawsuit in a court of law before a judge or jury. Nor will you be able to do so in an arbitration proceeding before an arbitrator.
Governing Law
The laws of the State of Texas, without regard to its principles of conflict of laws, shall govern these Terms.
Limitation of Liability
CARD ISSUER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY GIFT CARD INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD IS NON-FUNCTIONAL, DUE TO A SYSTEM ERROR, YOUR SOLE REMEDY SHALL BE THE REPLACEMENT OF THAT GIFT CARD. UNLESS PROHIBITED BY LAW, CARD ISSUER AND YOU AGREE TO LIMIT CLAIMS FOR DAMAGES OR OTHER MONETARY RELIEF AGAINST EACH OTHER TO DIRECT ACTUAL DAMAGES AND CARD ISSUER AND YOU WILL NOT SEEK ANY INDIRECT, SPECIAL, CONSEQUENTIAL, TREBLE, OR PUNITIVE DAMAGES FROM THE OTHER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
Change in Terms
Card Issuer reserves the right to modify these Terms at any time in our sole discretion for the limited purposes (a) of making modifications, if any, regarding redemption limitations, (b) to define modifications in limitations of use, (c) to describe courses of action in the event the Gift Card program is terminated, (d) to clarify existing terms and conditions, (e) to address changes in information such as links, or (f) to make other changes made in good faith provided that such other changes do not include (i) the addition of an expiration date, (ii) the application of new fees regarding the use or non-use of the Gift Cards, or (iii) a change to this Change in Terms clause. These changes will be made at https://www.iflyworld.com/gcterms without additional notice. The most current version of these Terms will be available on that site and will supersede all previous versions of these Terms except as otherwise specified.
Severability
Should these Terms , or any part thereof, be determined by any court, tribunal, arbitrator, or agency to be unenforceable, void, or voidable, or should any court, tribunal, arbitrator, or agency refuse or decline to enforce these terms and conditions or any part thereof, the remainder of these terms and conditions and all parts of it shall remain in effect, valid, and enforceable.
Cardholder Notices
Card Issuer does not maintain names or addresses of cardholders. Therefore, you agree that, to the extent permitted by applicable law, we may provide notice to you, including disclosures and amendments required under these Terms, by electronic means including by notices published at https://www.iflyworld.com/gcterms
Cessation of Business
The Gift Card program may be terminated in extraordinary circumstances such as (a) the cessation of business of the redeeming entities, (b) if needed in light of applicable laws and regulations, (c) the mutual business decision of Card Issuer and the redeeming entities that the Gift Card program has run its business course and should be ended on a going forward basis, and (d) in force majeure type situations that prohibit the operation of the program such as pandemics, sabotage, terrorism, civil unrest, or acts of God. In the event the Gift Card program is terminated, instructions to cardholders will be provided by notice given in accordance with these Terms.

Privacy Policy - Notice and Consent
We inform you that we are collecting your personal information and data for use to deliver your Gift Card and administer the Gift Card program. Your purchase, use or acceptance of the Gift Card constitutes your consent to such collection and use of your personal information and data. Our collection and use of personal information and data is subject to our Privacy Policy, located at https://www.iflyworld.com/privacy, which is referenced herein but not incorporated.

YOU ACKNOWLEDGE THAT YOU UNDERSTAND THAT YOU MAY CONSULT WITH AN ATTORNEY IN DECIDING TO ACCEPT THESE TERMS INCLUDING, WITHOUT LIMITATION, THE AGREEMENT TO ARBITRATE.
